ELIGIBILITY: Open only to persons who are 18 years of age or older and residents of Australia or New Zealand. Neither employees of HubSpot Australia or its affiliates, partners, nor their spouses, parents, children, siblings, or other immediate family are eligible to enter or win a prize. Current HubSpot CMS Hub subscription holders are not eligible to enter or win the competition if holding a CMS Hub subscription prior to, or during the competition. All applicable federal, state, municipal, territorial and local laws and regulations apply. Void where prohibited or restricted by law. No purchase is necessary to win. A purchase will not increase your chances of winning. All entries must be created using the HubSpot CMS Hub Enterprise free trial.

COMPETITION PERIOD: The HubSpot CMS Hub Website Challenge (“Competition”) entry period begins at the Entry Open Date above and ends at the Entry Close Date above (the "Competition Period"). Winner will be selected from entries properly submitted and timely received during the Competition Period.

HOW TO ENTER: During the Competition Period, start a CMS Hub Enterprise free trial using the button on the competition page. The trial lasts 14 days and you must submit your entry via the form emailed to you before your trial ends. Trial may be extended for the purposes of the competition only. If you start a trial with less than 14 days left in the competition, you will have until the Entry Closing Date listed above. Limit One (1) Entry per person, per e-mail address, per company and per household during the Competition Period via Online Entry, regardless of whether a person has more than one address or more than one person uses the same address.

JUDGING: The Competition is a Game of Skill. Chance plays no part in determining the winner. The winner will be determined by a panel of expert judges from Canva, Sendle, General Assembly, University of Sydney and HubSpot, based on the judging criteria set out on the event page business growth and use of the HubSpot platform, with the selection to be held on the Winner Selection Date above via collation of all judges' scores by the HubSpot marketing team. Winners will be selected from entries received during the Competition Period and determined by highest points earned from all judges scorecards. The potential winner will be notified via email to the email address submitted with the potential winner's entry on the date listed in the Summary of Competition Dates table. The selection will be conducted by HubSpot Australia and an external panel of experts, the judge of the Competition, whose decisions on all matters relating to the Competition shall be final. In the event that a potential winner is disqualified for any reason, an alternate winner will be selected. The alternate winner will be notified in writing within one (1) week of such selection. All entries deemed suitable will be displayed on the HubSpot website via a newly-created landing page after the competition. This is optional promotion at the discretion of HubSpot and does not guarantee any entries will be featured on the HubSpot website or promoted by HubSpot after the competition.

Prizes/Odds of Winning Prize: The first prize will consist of one-year subscription to the HubSpot CMS Hub Professional package, valued at a maximum of $5,000 AUD. This must be claimed no later than September 30th, 2020. The second prize will consist of a Canva Pro subscription for 10 users, valued at a maximum of $1,700. The third prize will consist of a General Assembly credit code, valued at a maximum of $1,000. The fourth prize will consist of a Prezzee digital gift voucher, valued at a maximum of $500 AUD. All entries deemed suitable by judges will get featured on the HubSpot website. All entrants will receive 50% off in General Assembly credits. Please note that there's a total limit of $250 off workshops per person, and this offer expires on the 31st December, 2020. Other additional terms and conditions may apply to third-party prizes and HubSpot are not responsible for the upholding or withdrawal of these conditions.

Overall odds of winning depend on number and quality of entries received during the Competition Period in relation to the judging criteria. Entries will be judged on their merit only in relation to the judging criteria. No prize substitution or cash equivalent of prize. No prize transfer. If the prize is unavailable, for whatever reason, HubSpot Australia reserves the right to substitute the prize for a prize of equal or greater value.

CONDITIONS: HubSpot Australia reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Competition (or portion thereof). HubSpot Australia also reserves the right at its sole discretion to disqualify the Entry of any individual who tampers with the entry process, submits an incomprehensible or incomplete entry, violates these Official Rules, or submits an entry that includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements or breaches any other person or entity's legal rights. Should a dispute arise regarding the identity of the claimant, HubSpot Australia reserves the sole right to determine the eligible party. HubSpot Australia reserves the right to request the winner to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of HubSpot Australia. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. All taxes on prizes and any expenses not specified herein are the sole responsibility of winner. Winner is solely responsible for (specific mandatory costs associated w/ prize, incl. vendor-levied taxes and other fees needed to obtain prize.) BY ENTERING, ENTRANT WAIVES ALL RIGHTS TO BRING (AND COVENANTS NOT TO BRING) ANY CLAIM AGAINST HUBSPOT AUSTRALIA, ITS AFFILIATES, OR ANY OTHERS ASSOCIATED WITH THIS COMPETITION. ENTRANTS FURTHER AGREE TO RELEASE AND HOLD HARMLESS HUBSPOT AUSTRALIA AND ITS AFFILIATES FROM ANY AND ALL LIABILITY ARISING FROM THEIR PARTICIPATION IN THE COMPETITION, OR HUBSPOT AUSTRALIA AND ITS AFFILIATES’ USE OF ANY ENTRY INFORMATION. Any disputes that may arise hereunder shall be governed in all respects by the laws of the state of New South Wales, Australia, without regard to the conflicts of laws principles of any jurisdiction.

ADDITIONAL ENTRY REQUIREMENTS: The following requirements apply to all entries:

- Entry must be entirely the original work of the persons identified in the entry;
- Entry must not be from an existing HubSpot CMS Hub subscription holder;
- Entry will not be eligible to win the HubSpot CMS Hub package if the entrant purchases a HubSpot CMS Hub subscription after entering the competition;
- Entry must not be from an existing HubSpot Partner;
- Entry must not contain any advertisement or solicitation;
- Entry must be created and built using the HubSpot CMS Hub Enterprise free trial;
- Entry must not contain anything that is or may be, as determined in HubSpot's sole discretion: (i) threatening, harassing, degrading or hateful; (ii) defamatory; (iii) fraudulent or tortious; (iv) obscene, indecent or otherwise objectionable; or (v) protected by copyright, trademark or other proprietary right without the express prior consent of the owner of such right;
– Entry must not contain any material that would give rise to criminal or civil liability or that encourages conduct that constitutes a criminal offence;
– Entry must not contain any materials that violate any applicable statute, regulation, order, rule, treaty, or other law (“Law(s)”), including but not limited to export control laws or laws governing use or transmission of harmful or hazardous materials; 
– Entry must not violate the terms of your employment or contain confidential or trade secret information; and
– Entry must not violate any third party’s publicity or privacy rights.
 

If any entry contains the name, voice, likeness, image or written or spoken words of any third party, the entrant must obtain the third party’s written consent to include such materials in the entry prior to submitting the entry. To the maximum extent permitted by Law, by entering the Contest, each entrant releases and holds harmless Sponsor and its parents, subsidiaries, and affiliates, and each of their respective officers, directors, employees, agents, and representatives (the “Sponsor Parties”) from any and all responsibility, liability, damages (including, without limitation, direct, indirect, incidental, consequential, punitive, statutory, and other damages), losses, costs, or expenses of any kind arising out of or relating to any violation by the entrant of these Rules or applicable Laws, including but not limited to  any copyright, trademark, patent, trade secret, or other intellectual property misappropriation or infringement attributable to entrant or any entry submitted by entrant. If anyone makes any claim against any of the Sponsor Parties arising out of or relating to any causes attributable to the entrant, the entrant will pay for any damages, losses, liabilities, costs, penalties, and expenses, including without limitation attorneys’ and experts’ fees and costs incurred in connection with such claim.

PUBLICITY AND RELEASE:  As a condition of entry into the Competition, except where prohibited by law, each entrant and each winner by accepting a prize grants to HubSpot Australia and its affiliates all right, title and interest in, to publicise, broadcast, reproduce, display and/or otherwise use, the Competition entrant’s name, city, state, biographical material, and entry (collectively, “Licensed Rights”) in any media for advertising and publicity purposes, without additional review, compensation, or approval of the winner. All entries must not infringe upon the legal rights, including copyrights, trademarks, contract rights, or any other intellectual property rights of any other person or entity. If Winner does not respond to notification, such prize will be forfeited. By participating, entrants agree to be bound by the Official Rules and the decisions of the judges, which are final and binding in all respects.

PRIVACY: HubSpot Australia collects and holds personal information of about entrants and any other individuals whose personal information is included in an entry to conduct the promotion and to enable them to participate in this promotion. Entrants agree they have informed any other person whose information they include in their entries of these terms and conditions and this clause in particular. If entrants do not wish their personal information to be used and disclosed for this purpose they cannot participate in the promotion. Personal information collected by the Promoter will otherwise be used and disclosed in accordance with the privacy policy of HubSpot which is available at http://www.hubspot.com/legal/privacy-policy and whose terms form part of these terms and conditions. The privacy policy explains how to request access to and correction of personal information, how to make a complaint and how complaints are handled and any overseas disclosures of the personal information HubSpot Australia collects. For avoidance of doubt, HubSpot Australia may disclose this personal information to its affiliates, including HubSpot, Inc., and may transfer data to other countries for such purpose.

OFFICIAL RULES/WINNERS LIST: For notification of the winners, send an email to marketingapac@hubspot.com from the email address you wish to receive the winners' list to. Requests for winners' lists must be received within one month after the end of the Competition Period.

FAQs

Who is this open to?
This is open to all non-HubSpot customers, and HubSpot direct customers that currently don't pay for a HubSpot CMS Hub subscription. The competition includes entrants of any skill level.

How will it be judged?
The competition will be judged on the merit of each entry only in relation to the judging criteria. Prior experience, skill level or occupation are not taken into account throughout the judging process.

Do I need to be a HubSpot customer to enter?
No, you don't have to be a HubSpot customer to enter. However, you cannot enter if you are a current paying HubSpot CMS Hub customer.

What if I purchase CMS Hub after entering the competition?
Anyone with a current CMS Hub subscription, purchased prior to or during the competition, will not be eligible to win the competition. All entries must have no paid HubSpot CMS Hub subscription.

Can HubSpot Agency Partners apply?
Employees of HubSpot Agency Partners may not apply. This competition is for non-customers and direct customers only. However, you may encourage your own customers to enter.

What if I submit my entry after the deadline?
Any entries submitted after the deadline of July 24th at 11:59PM (AEST) will not be considered for the competition.
